Allocation and transfer of licences
Can I assign or transfer my That’s Rights! +EasyRoyalties licence?
If you purchased a one-off purchase licence of That’s Rights! +EasyRoyalties, there are some cases where you may be able to transfer or re-allocated your licence(s).
Jeux de Couleur allows the original purchaser of a one-off software licence to transfer it under certain circumstances, including business mergers/acquisitions, internal staff re-organisation, creation of new imprints or divisions, etc.
Restrictions may apply however (please read on below). Jeux de Couleur may request detailed information about the circumstances regarding the transfer and the deployment of the software by the new licensees, and reserves the right to apply transfer fees or additional licence or software-support fees, or, at its sole discretion, to refuse to transfer a licence.
Which licences can be assigned or transferred?
Requests for transfers will only be considered for one-off licences of versions of Jeux de Couleur software that are still supported.
The following categories of licences cannot be assigned or transferred:
- Subscription licences
- Licences of unsupported (“sunset”) versions of Jeux de Couleur software
- Any specially-priced packages, site licences and any individual licences or other licence packages that are currently offered or have been previously offered at a special price whether by Jeux de Couleur or by its resellers (this includes special-occasion discounts, early-purchase discounts, small-publisher starter packages, etc.)
- Any one-off licences or packages for which there are outstanding payments, including payments for data services (e.g. data migration).
- Licences used by book (and other) distributors or any external rights & royalties contractors or consultants except for literary/rights agents.
Transfers or assignment of licences to/from business entities with different business activities are not permitted (e.g. Agents to Publishers, Publishers to Book Distributors, Publishers to Royalty Consultants/Accountants, Book publishers to Music/Film publishers etc.).
Limits on discounted licences and add-ons
If at the time of transfer there are limits set by Jeux de Couleur as to the number of discounted additional-user licences or to licence add-ons (e.g. Rights add-on) those limits will be applied to the package of licences that are transferred.
No subsequent transfers
Only licences that have been directly purchased from Jeux de Couleur or its authorised resellers can be transferred. The original licensee of the software can transfer the licence once, but subsequent licensees cannot.
Multi-user licences
Multi-user bundles of licences can be transferred only as one single bundle from one business entity, division or department, to another; partial transfers, unbundling and re-assignment of licences or allocation of new licences to different business or administrative entities, or to different divisions, departments, imprints or “sites” when applicable, than those to which the licence was first granted are not permitted.
Evaluation licences, short-term licences or any other specially arranged and/or specially priced licences.
Only licences that have been purchased at Jeux de Couleur’s published prices and any published volume discounts can be transferred. Evaluation licences, short-term licences or any other specially priced or complimentary licences cannot be transferred.
No transfer of licence(s) is valid unless agreed in writing between Jeux de Couleur Limited and the licensee.
